Title

Resolution to approve a Purchase and Sale Agreement by and between the City of West Allis and Summit Place, LLC. for the property located at 9** S. 70 St.

 

Body

WHEREAS, the Common Council of the City of West Allis is the owner of certain vacant property located at 9** S. 70 St.; and,

 

WHEREAS, the property is determined to be surplus and is not needed for City purposes; and,

 

WHEREAS. a development proposal has been received and recommended for approval by the West Allis Plan Commission; and,

 

WHEREAS, a Class II Notice of a public hearing on the proposed sale has been duly published and a Public Hearing was held before the Common Council on December 17, 2002.

 

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the proposal, hereby attached and made a part hereof; as received from Summit Place, LLC., is hereby approved in concept.

 

BE IT FURTHER RESOLVED that the Mayor and  Purchase and Sale Agreement by and between the City of West Allis and Summit Place, LLC, for the redevelopment of the property located at 9** S. 70 St., hereby attached and made a part hereof.

 

                     BE IT FURTHER RESOLVED that the Mayor and City Clerk/Treasurer be and are hereby authorized to execute and deliver the Agreement on behalf of the City of West Allis.

 

                     BE IT FURTHER RESOLVED that the City Attorney be and is hereby authorized to make such non-substantive changes, modifications, additions and deletions to and from the various provisions of the Agreement, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepare and deliver such other and further documents as may be reasonably necessary to complete the transactions contemplated therein.
