Title

Resolution Relative to the Vacation and Discontinuance of a Public Alley East of South 106th Street Between West Washington Street and West Madison Street.

Body

WHEREAS, the public interest requires that a Public Alley East of South 106th Street between West Washington Street and West Madison Street, shown and legally described on the map of the City of West Allis Engineering Department dated June 28th, 2011, File No. Y-1178, which is attached hereto and incorporated herein by reference, be vacated and discontinued; and,

WHEREAS, this Resolution was introduced before the Common Council of the City of West Allis on August 2nd, 2011; Notice of Pendency of the Resolution to vacate the aforesaid public alley was filed with the Register of Deeds of Milwaukee County on or about August 2nd, 2011; and Notice of Hearing was published in the official City newspaper on August 25th, 2011, September 1st, 2011 and September 8th, 2011; and,

WHEREAS, no sufficient written objection to the vacation and discontinuance was filed with the City Administrative Officer, Clerk/Treasurer.

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis, in accordance with the authority vested in the Common Council by Sec. 66.1003, Wisconsin Statutes, that a Public Alley East of South 106th Street between West Washington Street and West Madison Street, shown and legally described on the map of the City of West Allis Engineering Department dated June 28th, 2011, File No. Y-1178, which is attached hereto and incorporated herein by reference, be and the same is hereby vacated and discontinued, as required by the public interest.

BE IT FURTHER RESOLVED that certain public utility easements for gas, water, storm sewer, sanitary sewer and electric, upon, along, through and under the parcel of property shown and legally described on the map of the City of West Allis Engineering Department dated June 28th, 2011, File No. Y-1178, which is attached hereto a...
