Resolution authorizing a $675,000 grant agreement #BF FY05-11879 Brownfield Grant Contract between the Wisconsin Department of Commerce and City of West Allis.

 

Body

 

WHEREAS, the City of West Allis recognizes that the remediation and redevelopment of brownfields is an important part of protecting Wisconsin's resources; and,

 

WHEREAS, by Resolution No. R2004-0094, approved March 16, 2004, authorized the Director of Development to submit a Brownfield Application for the property at 1960 S. 67 Pl. (the Lime Pit) and the subsequent appropriation of necessary local matching funds for a Wisconsin Department of Commerce Brownfield Grant; and,

 

WHEREAS, the Common Council of the City of West Allis has declared its intent to complete the Brownfield Grant activities described in the application; and,

 

WHEREAS, the City of West Allis will maintain records documenting all expenditures made during the Brownfield Grant period; and,

 

WHEREAS, the City of West Allis will allow employees from the Wisconsin Department of Commerce access to inspect the grant site or facility and grant records; and,

 

WHEREAS, the City of West Allis will submit the necessary reporting requirements and a final report to the Wisconsin Department of Commerce which will accompany the final payment request; and,

 

WHEREAS, the grant is funded on a reimbursement basis.  As a result, any negative fund balance will be funded by the general fund and at an interest rate as determined by the Office of the City Comptroller.

 

NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of West Allis authorizes a $675,000 grant agreement #BF FY05-11879 from the Wisconsin Department of Commerce under the Brownfield Grant Program and will comply with state rules for the program.

 

BE IT FURTHER RESOLVED that the City Attorney be and is hereby authorized to make such non-substantive changes, modifications, additions and deletions to and from the various provisions of the contract, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepare and deliver such other and further documents as may be reasonably necessary to complete the transactions contemplated therein.

 

BE IT FURTHER RESOLVED that the Director of Development be and is hereby authorized to execute and deliver the contract on behalf of the City of West Allis.
