A Resolution Authorizing Parking on South 116th Street from Lincoln Avenue north to West Rogers Street During Declared Snow Emergencies and Authorizing the Director of Public Works to Enter into a Contract with Winter Services to Plow that portion of South 116th Street.

WHEREAS, by Ordinance Number O-2014-0077 the West Allis Common Council amended section 10.11(2) of the Revised Municipal Code to allow for parking on snow emergency routes where the Common Council has approved the posting of parking permitted signs; and,
WHEREAS, Winter Services has requested that the City of West Allis allow such parking on South 116th Street between West Lincoln Avenue north to West Rogers Street; and,
WHEREAS, Winter Services has offered to plow that portion of South 116th Street in order to allow parking on South 116th Street for its employees during declared snow emergencies; and,
WHEREAS, Winter Services has offered to pay for the cost of making, erecting, maintaining, and replacing the parking permitted during snow emergency signs on the designated portion of South 116th Street; and,
WHEREAS, it is deemed to be in the City’s interest to allow parking on the designated portion of South 116th Street during snow emergencies in order to accommodate Winter Service’s restricted parking situation where Winter Services agrees to assume responsibility for the snow plowing operations on that portion of the street and pay for all costs associated with posting and maintaining the parking signs.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that South 116th Street between West Lincoln Avenue and West Rogers Street may be posted with parking permitted during snow emergency signs consistent with section 10.11(2) of the Revised Municipal Code by the Director of Public Works or his designee at his discretion and subject to the following conditions:
(1) Winter Services agrees to pay for the cost of making and installing said signs and agrees to and does pay for any future repair, maintenance, and replacement of said signs.
(2) During declared snow emergencies, Winter Services agrees to plow the signed portion of South 116th Street between West Lincoln Avenue and West Rogers Street.
(3) The snow plowing by Winter Services shall be done within the time and to the specifications established by the Director of Public Works or his designee.
(4) Winter Services shall obtain and maintain general commercial liability insurance in the amount of at least $1 Million per occurrence and $2 Million aggregate, auto liability insurance in the amount of at least $1 Million, and worker’s compensation insurance per statutory requirements. The commercial liability and auto policies shall name the City of West Allis as an additional insured. All insurance policies shall waive the right to recover as against the City of West Allis, shall be primary, and shall provide notification of cancellation to the City. All such proof of insurance and endorsements shall be in a form acceptable to the City Attorney.
