Title

Resolution authorizing application to the Department of Natural Resources for principal forgiven financial assistance agreement in an amount up to $2,700,000 to undertake a project to replace private lead service lines.

 

Body

WHEREAS, the City of West Allis (the “Municipality“) wishes to undertake a project to replace private lead service lines at residences, pre k -12 schools and licensed day care centers, identified as DNR No. 5404-06 (the “Project”); and

 

WHEREAS, the Municipality has submitted an Intent to Apply for funding to the Safe Drinking Water Loan Program (the “SDWLP”) for financial assistance in the form of a loan made by the SDWLP to the Municipality of which all or a portion of the principal will be forgiven at the time that loan disbursements are made to the Municipality, pursuant to the DNR Financial Assistance Agreement in October of 2023; and

 

WHEREAS, the Municipality intends to reimburse municipal accounts with the financial assistance proceeds of the Safe Drinking Water Loan; and

 

WHEREAS, the SDWLP has, in the past, identified that the Municipality is eligible for full and/or partial reimbursement of a SDW loan.

 

NOW THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis as follows:

 

1.                      that the Mayor, City Clerk, and/or City Engineer are authorized by and on behalf of the Municipality to execute the application for the Principal Forgiven Financial Assistance program of the SDWLP.

 

2.                     That the funding for the Lead Service Water Lateral program will be from the Safe Drinking Water Loan Program, both full principal forgiveness and partial principal forgiveness and special assessments. Principal that is not forgiven or covered by special assessments will be paid from the general City tax levy, unless other funding becomes available.

 

 

BE IT FURTHER RESOLVED that the City Engineer be and is hereby authorized to make such non-substantive changes, modifications, additions and deletions to and from the various provisions of the Application, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepare and deliver such other and further documents as may be reasonably necessary to complete the transactions contemplated therein.
