Title
Ordinance to amend various sections of the Zoning Chapter of the Revised Municipal Code relative to establishing certain permitted and special uses and required conditions for commercial animal related uses including veterinary and small animal clinics, pet shops, animal shelters/kennels, and animal grooming facilities for the holding and care of animals within Sections 12.40(2) special uses of the Central Business District, 12.41(1) and (2) permitted and special uses of the Neighborhood Commercial District, 12.42(1) and (2) permitted and special uses of the Community Commercial District and 12.43(2) special uses of the Regional Commercial District.

The Common Council of the City of West Allis do ordain as follows:
PART I. Section 12.40(2)(v)of the Revised Municipal Code of the City of West Allis is hereby amended to read:
12.40 C-1 Central Business District

(2) Special Uses.
***
(v) Veterinary and small animal clinics, pet shops, animal shelters/kennels, and animal grooming facilities provided:
(i) animals prohibited under Section 7.12 of the Revised Municipal Code shall not be permitted;
(ii) outdoor animal holding areas and runs shall not be allowed;
(iii) animal reproduction shall not be permitted.

PART II. Section 12.41(1)(y) Pet shops, of the Revised Municipal Code of the City of West Allis is hereby amended to read:
12.41 C-2 Neighborhood Commercial District
(1) Permitted Uses

(y) Pet shops and animal grooming facilities provided:
(i) animals prohibited under Section 7.12 of the Revised Municipal Code shall not be permitted;
(ii) outdoor animal holding areas and runs shall not be allowed;
(iii) animal reproduction shall not be permitted.

PART III. Section 12.41(2)(aa) Veterinary clinics, of the Revised Municipal Code of the City of West Allis is hereby amended to read:
(2) Special Uses

(aa) Veterinary and small animal clinics and animal shelters/kennels provided:
(i) animals prohibited under Section 7.12 of the Revised Municipal Code shall not be permitted;
(ii) outdoor animal holding areas and runs shall not be allowed;
(iii) animal reproduction shall not be permitted.
PART IV. Section 12.42(1)(hh) Veterinary and small animal clinics, of the Revised Municipal Code of the City of West Allis is hereby amended to read:
12.42 C-3 Community Commercial District
(1) Permitted Uses

(hh) Veterinary and small animal clinics, and animal shelters/kennels provided:
(i) animals prohibited under Section 7.12 of the Revised Municipal Code shall not be permitted;
(ii) outdoor animal holding areas and runs shall not be allowed;
(iii) animal reproduction shall not be permitted.

PART V. Section 12.42(2)(f) Kennels, of the Revised Municipal Code of the City of West Allis is hereby rescinded.

PART VI. Section 12.43(2)(m) Reserved, of the Revised Municipal Code of the City of West Allis shall be amended to read:
12.43 C-4 Regional Commercial District

(2) Special Uses
***
(m) Kennels (outdoor) provided:
(i) animals prohibited under Section 7.12 of the Revised Municipal Code shall not be permitted;
(ii) animal reproduction shall not be permitted.
PART VII. All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby amended.
PART VIII. This ordinance shall take effect and be in force from and after its passage and publication.
