Resolution relative to determination of Special Use Application for pump station improvements to the existing MMSD pump station located within the median of the 7400 block of W. Oklahoma Ave.

WHEREAS, Kapur and Associates, on behalf of the Milwaukee Metropolitan Sewerage District (MMSD), duly filed with the City Administrative Officer-Clerk/Treasurer an application for a Special Use Permit, pursuant to Sec. 12.16, Sec. 12.42(2) and Sec. 12.31(3)(e) of the Revised Municipal Code of the City of West Allis for improvements to the existing MMSD pump station public utility located within the 7400 block of W. Oklahoma Ave.; and,

 

WHEREAS, after due notice, a public hearing was held by the Common Council on September 20, 2005, at 7:00 p.m., in the Common Council Chambers to consider the application; and,

 

WHEREAS, the Common Council, having carefully considered the evidence presented at the public hearing and the following pertinent facts noted:

 

1.                     The applicant, the Milwaukee Metropolitan Sewerage District, has principal offices at 260 West Seebooth Street, Milwaukee, WI  53204.

 

2.                     The applicant has submitted an application for special use and has ascertained that the work on the station is part of the Conveyance Pump Stations Improvements Project, MMSD Contract C98039C01, being designed by Kapur and Associates, Inc. 

 

The 74th and Oklahoma Bypass Pump Station is located in the median of W. Oklahoma Ave. and S. 74 St.  It is located both in West Allis on the north half and the City of Milwaukee on the south half of the island.  The wet weather bypass pump station was previously constructed in 1960 to relieve surcharging of an adjacent 21-inch MIS.  The existing station has two 5,000 gpm pumps that discharge to Honey Creek.  The pump motors are located in a dry well vault about 10 feet below grade. It is "sealed" from the wet well below where the pumps are located.  The dry vault is a confined space area and houses the electrical panels, hydraulic power unit for the sluice gate, dehumidifier, sump pump, heater and SCADA control panels.

 

The upgrade of the 74th and Oklahoma Bypass Pump Station (BS0303) was identified in the Immediate Attention Memorandum submitted to the MMSD in June of 2001.  The memorandum recommended that the pump station improvements be made in 2002 to 2004 to extend the service life of the station and improve its operation and maintenance.

 

The 74th and Oklahoma Bypass Pump Station upgrade will be used as a backup system in the event of increased flows to prevent sanitary backups into area properties.  Furthermore, the new pump station upgrade will:

 

• Remove all electrical panels, control panels, lighting and HVAC equipment from the below ground chambers

• Remove existing wet pit/dry pit pumps and replace with two 10,000 gpm submersible non-clog solids handling mixed flow pumps

• New elastomer check valves will be installed in existing valve vault

• New stainless steel sluice gate and controls will be installed to control flow to the station from the adjacent MIS

• Replace existing electrical power distribution panels

• Install guard posts

• Install wet well dewatering pump

 

When locating the new electrical panel and control panel on the surface, great care was taken to provide vision clearance for the driver that would be stopped on S. 74 St. and within the median looking for oncoming traffic traveling down the east bound lane of W. Oklahoma Ave.  The above ground panels have been relocated to the north side of the median/island and moved further west away from the median opening.  A four-foot high panel is located on the south side of the median within the City of Milwaukee.

 

3.                     The aforesaid property is zoned C-3 Community Commercial District to permit public utilities as a special use, pursuant to Sec. 12.42(2), Sec. 12.31(3)(e) and Sec. 12.16 of the Revised Municipal Code of the City of West Allis.

 

4.                     The proposed installation should not contribute to traffic volumes or traffic flow in the area as the proposed facilities require minimal visitation by maintenance personnel and is located to minimize conflict with turning movements within the existing median opening.

 

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the application of the Milwaukee Metropolitan Sewerage District, for improvements to the existing MMSD pump station public utility located with the 7400 block of W. Oklahoma Ave., be, and is hereby granted on the following grounds:

 

That the establishment, maintenance and operation of the proposed use, with the imposition of certain conditions hereinafter set forth, reasonably satisfies the standards set forth in Secs. 12.16 of the Revised Municipal Code, so as to permit the issuance of a Special Use Permit as therein provided.

 

BE IT FURTHER RESOLVED that said Special Use Permit is granted subject to the following conditions:

 

1.                     Landscaping.  The grant of this Special Use Permit is subject to and conditioned upon the site, landscaping and architectural plans, approved August 24, 2005, by the City of West Allis Plan Commission as provided in Sec. 12.13 of the Revised Municipal Code of the City of West Allis.  No alteration or modification of the approved plan shall be permitted without approval by the Plan Commission.

 

2.                     Building and Fire Codes.  The grant of this Special Use Permit is subject to all building and fire codes being complied with.

 

3.                     Permits.  All necessary local and county permits being obtained by the Milwaukee Metropolitan Sewerage District (MMSD).

 

4.                     Expiration of Special Use Permit.  Any special use approved by the Common Council shall lapse and become null and void one (1) year from and after that approval if the use has not commenced, construction is not underway, or the owner has not obtained a valid building permit.  An extension of these time limitations may be granted without a public hearing by the Common Council by resolution reauthorizing the special use in accordance with the following criteria:

 

A.                     The applicant requesting the extension shall complete a planning application available from the Department of Development and shall submit a $250.00 extension fee.

 

B.                     A written explanation for the extension of time shall accompany the planning application along with a timeline/schedule for obtaining necessary permits, zoning, state and municipal approvals and a target date for construction start;

 

C.                     The request for extension shall be submitted within sixty (60) days of the expiration of the special use permit;

 

D.                     The extension, if granted, shall be valid for a period of six (6) months.  If no building permit has been issued and construction has not commenced within six (6) months from and after the extension has been granted, the special use shall become null and void.

 

5.                     Miscellaneous

 

A.                     Applicants are advised that the foregoing conditions are reasonably necessary to protect the public interest and to secure compliance with the standards and requirements specified in Sec. 12.16 of the Revised Municipal Code; that the issuance of the special use is expressly subject to compliance with said conditions.

 

B.                     The use, as granted herein, is subject to applicants' compliance with all other state and local laws and regulations which may be applicable to the proposed use of the real estate in question.

 

C.                     The special use, as granted herein, shall run with the land and benefit and restrict all future owners and occupants of the property, unless the use shall lapse or be terminated and the use will not be altered or extended (including structural alterations and/or additions) without the approval of the Common Council, following public hearing, all as provided in Sec. 12.16 of the Revised Municipal Code.
