An Ordinance to Amend Subsections 7.05(1)(t), 7.05(3)(a)1 and 7.05(4)(a)1 of the West Allis Revised Municipal Code Relating to Changing the Definition of "Residential Container" and to Require that all Residential Waste be Placed in Containers Purchased Through the City.

The Common Council of the City of West Allis do ordain as follows:
 
PART I.      Subsection 7.05(1)(t) of the Revised Municipal Code of the City of West Allis is hereby amended to read:
 
7.05      REFUSE COLLECTION.
 
(1)      Definitions.  As used in this Section.

(t)      "Residential Container" means a receptacle designed for mechanical collection for the storage of residential refuse purchased thru the City of West Allis or purchased from a provider that meets the specifications established by the Director of Public Works, and maintained and located as provided in Subsection (4)(a) below.

PART II.      Subsection 7.05 (3)(a)1 of the Revised Municipal Code of the City of West Allis is hereby amended to read:
 
7.05      REFUSE COLLECTION.

(3)      Preparation, Storage and Disposal.
 
(a)      Residential.  Except as provided in Paragraph (b) below, residential wastes shall be prepared and stored as follows:
 
1.      Garbage.  Garbage shall be drained of all free liquid and store in residential containers.

PART III.      Subsection 7.05(4)(a)1 of the Revised Municipal Code of the City of West Allis is hereby amended to read:
 
7.05      REFUSE COLLECTION.

(4)      Containers.
 
(a)      Residential containers shall be maintained and located as follows:
 
1.      Maintenance.  Residential containers shall be maintained in good working order with the wheels and cover functioning properly.  The body of the container shall be free from cracks or holes.  If the Department of Public Works or his designee determines that a residential container does not meet the criteria set forth herein, the owner/occupant of the property shall be notified that they must repair or replace the container.  No further refuse shall be collected at the residential property until the container is repaired or replaced to the satisfaction of the Department of Public Works or his designee.

PART IV.      No person shall be required to purchase a cart in conformity with Section 7.05(1)(t) until two (2) years after the effective date of this ordinance.
 
PART V.      All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby amended.
 
PART VI.      This ordinance shall take effect and be in force from and after its passage and publication.
