Resolution to rescind Resolution R-2010-0057, and accepting work of D.C. Burbach, Inc. for the removal and reconstruction of the concrete alley pavement, storm sewer, storm spot relay, utility adjustments and storm underdrain in various alleys in West Allis and authorizing and directing settlement of said contract in accordance with contract terms of 2009 Project No. 1.

WHEREAS, on March 2, 2010, Resolution No. R-2010-0057 was adopted by the Common Council of the City of West Allis, accepting work of Milwaukee General Construction, Inc. for the removal and reconstruction of the concrete alley pavement, storm sewer, storm spot relay, utility adjustments and storm underdrain in various alleys in West Allis and authorizing and directing settlement of said contract in accordance with contract terms of 2009 Project No. 1; and
WHEREAS, the City Engineer's Office has since determined that D.C. Burbach, Inc. should have been named for the accepted work and contract settlement for 2009 Project No. 1 instead of Milwaukee General Construction, Inc.; and
WHEREAS, D.C. Burbach, Inc. has completed their contractual obligations in accordance with the plans and specifications therefore, attested by the approval for payment by the Director of Public Works/City Engineer;
NOW THEREFORE BE IT RESOLVED that Resolution No. R-2010-0057 adopted by the Common Council of the City of West Allis be rescinded; and
BE IT FURTHER RESOLVED By the Common Council of the City of West Allis that the work of:
D.C. Burbach, Inc. - 2009 Project No. 1
For the removal and reconstruction of the concrete alley pavement, storm sewer, storm spot relay, utility adjustments and storm underdrain in:
North/South and East/West alleys between S. 71 St. and S. 72 St.: W. Grant St. to W. Lincoln Ave. (2008 Alley # 12)
North/South and East/West alleys between S. 74 St. and S. 75 St.: W. Grant St. to W. Lincoln Ave. (2008 Alley # 9)
North/South and East/West alleys between S. 78 St. and S. 79 St.: W. Lincoln Ave. to W. Hayes Ave. (2008 Alley # 10)
North/South and East/West alleys between W. Van Dyke Pl. and S. 76 St.: W. Beloit Rd. to W. Cleveland Ave. (2008 Alley # 11)
East/West alley between S. Wollmer Rd. and S. 112 St.: W. Ohio St. to W. Wildwood Ln. (Eastern half of East/West Alley ONLY) (2008 Alley # 13)
be and the same is hereby accepted, and the proper City officers are hereby authorized and directed to make settlement with said contractor in accordance with terms of said contract.
