Resolution approving a Planned Development District Residential PDD-1 between the City of West Allis, H.O.L.I.E., Inc., and St. Aloysius Parish to establish a Planned Development Agreement for construction of an elderly living apartment complex addition to the existing convent building at 1415 S. 92 St., also further encompassing 1405-35 S. 92 St., 14** S. 92 St., and 1414 S. 93 St. (Tax Key Nos. 450-0001-003, 450-0093-001, 450-0094-000, 450-0095-000, 450-0096-000, 450-0097-000, and 450-0102-000)

WHEREAS, H.O.L.I.E., Inc., with principal offices at 7400 W. Lapham St., West Allis, WI 53214, and St. Aloysius Parish, with principal offices at 1414 S. 93 St., West Allis, WI 53214, (the "Developer"), have submitted an application for a Planned Development District Residential PDD-1 pursuant to Section 12.60 of the West Allis Revised Municipal Code for certain lands depicted and described as:
A tract of land being part of the Blocks 1 and 8 in the Zingen and Braun's Fair Park, located in the Northeast ΒΌ of the Section 5, Township 6 North, Range 21 East, in the City of West Allis, Milwaukee County, State of Wisconsin, more particularly described as follows:
Beginning at the Northeast corner of said Section 5; thence Southerly, 713.04 feet, along east line of said Section 5 and centerline of South 92nd Street, to the South line of Lot 6, extended; thence Westerly, 278.50 feet, to the centerline of South 93rd Street; thence Northerly, 231.88 feet, along said centerline; thence Northwesterly, 157.61 feet, along said centerline; thence Northerly, 325.01 feet, along said centerline, to the North line of said Section 5, and centerline of West Greenfield Avenue; thence Easterly, 300.71 feet, along said North line to the Point of Beginning.
Said area contains 4.7679 Acres, more or less.

WHEREAS, the Application was forwarded to the Plan Commission on February 23, 2006, for review and recommendation and its recommendation has been received; and,
WHEREAS, the Common Council has duly noticed and held a Public Hearing on May 16, 2006, on the Application; and,
WHEREAS, the Common Council, after due consideration, finds that the proposed development as set forth in the Application, with certain conditions, meets the standards set forth in Sections 12.60 of the West Allis Revised Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the Agreement for Planned Development District Residential PDD-1 by and between the City of West Allis, H.O.L.I.E., Inc., and St. Aloysius Parish, a copy of which is attached and made a part hereof, be and is hereby approved and that the Mayor and City Administrative Officer-Clerk/Treasurer are hereby authorized and directed to execute and deliver said Agreement on behalf of the City, together with all such other and further instruments and documents, as may be required by said Agreement, for its full and complete implementation.
BE IT FURTHER RESOLVED that the City Attorney be and is hereby authorized to make such non-substantive changes, modifications, additions and deletions to and from the various provisions of the Agreement and other documents, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepare and deliver such other and further documents as may be reasonably necessary to complete the transactions contemplated therein.
BE IT FURTHER RESOLVED that the Official City Zoning Map be and is hereby amended by overlay of the Planned Development District Residential PDD-1 approved hereby.
