Ordinance to Create Sections 7.121(3) and 11.13(1)(p) and Amend Section 6.09(1)(a) of the West Allis Municipal Code Relating to rules and fees for the West Allis Dog Park

Whereas, the West Allis Dog Park located at 11200 West Hayes Avenue opened on December 14, 2019; and
Whereas, the ongoing success of the park will be dependent upon the users of the park complying with basic standards;
Now, therefore, the Common Council of the City of West Allis, Milwaukee County, do ordain as follows:
Part 1. Code Revision
Section 7.121(3) of the Municipal Code of the City of West Allis is hereby created to read as follows:
(3) West Allis Dog Park
(a) Fees. No person may bring a dog into the fenced in area of the West Allis Dog Park without carrying proof of payment of the proper fee as stated in the Fee Schedule and displaying proof of payment upon the request of a law enforcement officer.
(b) Age Minimum. No person may bring a dog into the fenced in area of the West Allis Dog Park unless the dog has reached at least 5 months of age.
(c) De-sexing. No person may bring a dog into the fenced in area of the West Allis Dog Park unless the dog has been neutered through castration, spaying, or other permanent means.
Part 2. Code Revision
Section 6.09(1)(a) of the Municipal Code of the City of West Allis is hereby amended to read as follows:
(a) "Parks" means all lands that are designated as City parks or playgrounds under section 11.13 of this Codewithin the City of West Allis, including Garfield School, Honey Creek, Klentz, Kopperud, Liberty Heights, North Greenfield Railroad Station Park, Joyce Radtke, Reservoir, Rogers and Veterans' Housing and Memorial Parks; and McKinley Park, Rogers, and Washington playgrounds.
Part 3. Code Revision
Section 11.13(1)(p) of the Municipal Code of the City of West Allis is hereby created to read as follows:
(p) West Allis Dog Park (11200 West Hayes Avenue).
Part 4. Inconsistent Law Repealed
All ordinances or parts of ordinances inconsistent with the provisions of this ordinance are hereby repealed.
Part 5. Severability
The provisions of this ordinance are severable. If any provision of this ordinance is invalid, or if the application of this ordinance to any person or circumstance is invalid, such invalidity shall not affect other provisions or applications which can be given effect without the invalid provision or application.
Part 6. Effective Date
This ordinance shall take effect and be in force as of January 1, 2020.
