Title

Resolution authorizing the Director of Public Works/City Engineer to amend an existing Contract with Bloom Companies, LLC for Engineering Consulting Services related to the Crosstown Connector Bike and Pedestrian Trail for an amount not to exceed $20,015.73.

 

Body

WHEREAS, the City has an existing agreement with Bloom Companies, LLC to perform construction management services on the Crosstown Connector Bike and Pedestrian Trail; and,

 

WHEREAS, Bloom Companies, LLC has been working on this specific project under a 3-party contract with both the City and Wisconsin Department of Transportation for over 12 years and has already completed 70% of the work needed to deliver these plans and reports to WisDOT; and,

 

WHEREAS, On August 7, 2017 the City’s Engineering Department inexplicably received notification that the Wisconsin Department of Transportation would not continue to participate in 80% of the cost for any new design services on the Crosstown Connector Bike and Pedestrian Trail; and, 

 

WHEREAS, The Wisconsin Department of Transportation encouraged the City of West Allis to accomplish these additional design services under a 2-party contract between Bloom Companies, LLC and the City of West Allis; and, 

                     

WHEREAS, The City’s Engineering Department immediately contacted Representative Joe Sanfelippo, who met with the Deputy Secretary of Transportation the very next day on August 8, 2017; but to this day he has still not received any explanation from WisDOT for their decision to back out of funding the additional design services for the bike trail; and,

 

WHEREAS, The City will now be required to pay 100% of the additional design costs on this project which are expected to total $20,015.73.  But the Wisconsin Department of Transportation is still obligated by their previously executed State Municipal Agreement with the City to fund 80% of the construction costs for this project from the federal funding which remains unspent, up to a maximum of $589,700; and, 

 

WHEREAS, Conversely, this same State Municipal Agreement executed by the City would require the City to reimburse the Wisconsin Department of Transportation for any design costs previously incurred by WisDOT if the City fails to deliver completed construction plans by the deadline of September 25, 2018.  These design costs which the City would be expected to reimburse WisDOT for are estimated to exceed $200,000.00; and,

 

WHEREAS, The City has already missed a milestone deadline for the project while we have been waiting since May 30, 2017 for a funding decision from WisDOT; the revised Environmental Report was due on July 12, 2017.  There are several other looming deadlines approaching as well such as the submittal of 60% plans and a revised Design Study Report which are both due on November 1, 2017; and,                     

 

WHEREAS, the Common Council deems it to be in the best interests of the City of West Allis that the City enter into a 2 party contract with Bloom Companies, LLC because they are very familiar with this project and are the only firm that can now complete the plans and reports for this project within the severe time constraints and within the proposed budget of $20,015.73.

 

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Common Council of the City of West Allis that the proposal dated May 30, 2017 submitted by Bloom Companies, LLC for furnishing Engineering Consulting Services related to the Crosstown Connector Bike and Pedestrian Trail for an amount not to exceed $20,015.73 is hereby accepted.

 

BE IT FURTHER RESOLVED that the Director of Public Works/City Engineer be and is hereby authorized to enter into an amended Professional Services Contract with Bloom Companies, LLC for Engineering Consulting Services and that the Director of Public Works/City Engineer is directed and authorized to use Community Development Block Grant (CDBG) funds and/or Capital Improvement Funds to pay for these services and related work.
