Resolution Relative to Vacation and Discontinuance of a Portion of West Mitchell Street Between South 91st Street and South 92nd Street.

WHEREAS, the public interest requires that a portion of West Mitchell Street Between South 91st Street and South 92nd Street, shown and legally described on the map of the City of West Allis Engineering Department dated December 21st, 2007, File No. Y-1164, which is attached hereto and incorporated herein by reference, be vacated and discontinued; and,
WHEREAS, this Resolution was introduced before the Common Council of the City of West Allis on January 15th, 2008; Notice of Pendency of the Resolution to vacate the aforesaid street right-of-way was filed with the Register of Deeds of Milwaukee County on or about January 15th, 2008; and Notice of Hearing was published in the official City newspaper on February 21st, 2008, February 28th, 2008 and March 6th, 2008; and,
WHEREAS, no sufficient written objection to the vacation and discontinuance was filed with the City Administrative Officer, Clerk/Treasurer.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis, in accordance with the authority vested in the Common Council by Sec. 66.1003, Wisconsin Statutes, that a portion of West Mitchell Street Between South 91st Street and South 92nd Street, shown and legally described on the map of the City of West Allis Engineering Department dated December 21st, 2007, File No. Y-1164, which is attached hereto and incorporated herein by reference, be and the same is hereby vacated and discontinued, as required by the public interest.
BE IT FURTHER RESOLVED that certain public utility easements for gas, water, storm sewer, sanitary sewer and electric, upon, along, through and under the parcel of property shown and legally described on the map of the City of West Allis Engineering Department dated December 21st, 2007, File No. Y-1164, which is attached hereto and incorporated by reference, and rights incidental thereto, and all rights of entrance, maintenance, construction and repair of the same, shall continue following the aforesaid vacation pursuant to the provision of Sec. 80.32(4), Wisconsin Statutes.
