Resolution authorizing and directing the Director of Public Works/City Engineer to enter into a Memorandum of Understanding with the Wisconsin Department of Transportation for the construction of a new Local Street Connection between 60th Street and 70th Street to facilitate local traffic accessing Interstate Highway 94.

WHEREAS, the Wisconsin Department of Transportation is tentatively planning to reconstruct the I-94 freeway from 70th Street to 25th Street in the year 2019; and
WHEREAS, the Wisconsin Department of Transportation is contemplating the construction of a preferred alternative which does not include the replacement of access ramps to Hawley Road/ 60th Street and which may have a dramatic effect on the land use and development patterns in the City of West Allis; and
WHEREAS, the Wisconsin Department of Transportation has proposed to design and construct a new Local Street Connection between 60th Street and 70th Street to facilitate local traffic accessing Interstate Highway 94; and
WHEREAS, the Wisconsin Department of Transportation will provide the design and construction of the new local street connection including the new signalized intersections, the purchasing of all needed right of way, and the relocating of the existing State Service facility; and
WHEREAS, the City of West Allis shall accept jurisdiction of the new Local Street Connection once it is completed, including the right of way.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the Director of Public Works/City Engineer be and is hereby authorized and directed to enter into a Memorandum of Understanding with the Wisconsin Department of Transportation for the new Local Street Connection project, a copy of the Memorandum of Understanding being attached hereto and by reference made a part hereof.
BE IT FURTHER RESOLVED that the Director of Public Works/City Engineer shall forward a certified copy of this Resolution, together with the executed Memorandum of Understanding, to the office of the Wisconsin Department of Transportation and take whatever further action is required to initiate and effect the street improvement.
BE IT FURTHER RESOLVED that the Director of Public Works/City Engineer be and is hereby authorized to make such non-substantive changes, modifications, additions and deletions to and from the various provisions of the Memorandum of Understanding, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepare and deliver such other and further documents as may be reasonably necessary to complete the transactions contemplated therein.
