Title
Resolution Approving an Extension of the Ground Lease Agreement by and between the City of West Allis and the United States Postal Service for Parking in the off-street Municipal Parking Lot.
 
Body
WHEREAS, by Resolution No. 26025, adopted March 2nd, 1999, the City of West Allis entered into a five (5) year extended  Lease Agreement, ending on July 31st, 2005, with the United States Postal Service for rental of forty (40) parking stalls in the off-street municipal parking lot on the west side of South 74th Street and north of the east/west alley of West Greenfield Avenue; and,
 
WHEREAS, by Public Works Committee Communication File No. 221/240 and approved by the Common Council of the City of West Allis on July 1st, 2002, an additional five (5) year extended Ground Lease Agreement, to end on July 31st, 2010, was executed by and between the City of West Allis and the United States Postal Service with an annual payment of seven-thousand five-hundred sixty dollars ($7,560.00); and,
 
WHEREAS, by Resolution R-2007-0272, the City of West Allis extended the Ground Lease Agreement for another five (5) years, ending on July 31st, 2015, with the United States Postal Service, with an annual payment of eight-thousand four-hundred dollars ($8,400.00).
 
WHEREAS, the United States Postal Service has submitted a new five (5) year extended Ground Lease Agreement, to end on July 31st, 2020, with an annual payment of eight-thousand seven-hundred & nine dollars ($8,709.00), to assure the United States Postal Service the continued uninterrupted use of the forty (40) parking stalls referenced above.
 
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the attached Ground Lease Agreement by and between the City of West Allis and United States Postal Service, for the rental of forty (40) parking stalls in the off-street municipal parking lot on the west side of South 74th Street and north of the east/west alley of West Greenfield Avenue, be and the same is hereby approved.
 
BE IT FURTHER RESOLVED that the Director of Public Works/City Engineer and other appropriate City Officials are hereby authorized and directed to execute and deliver the aforesaid extended Ground Lease Agreement on behalf of the City of West Allis.
 
BE IT FURTHER RESOLVED that the City Attorney be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the Ground Lease Agreement, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, including but not limited to, any and all changes necessary to preserve the intent of the Common Council of the City of West Allis.
