Title

Ordinance to amend Sections 12.43 and 12.45 of the Revised Municipal Code relative to permitting commercial truck sales/repair as a Special Use in the M-1 Manufacturing District and amending outdoor storage site planning criteria.

 

Body

The Common Council of the City of West Allis do ordain as follows:

 

PART I.                     Subsection 12.43(2)(j) of the Revised Municipal Code of the City of West Allis is hereby amended to read:

 

12.43                     C-4 Regional Commercial District.

(2)                     Special Uses.

 

* * *

 

(j)                     Private passenger vehicle sales, rental and leasing, including repair, rebuilding and parts, and outdoor display conditioned upon the following:

 

1.                     Minimum lot size:  one (1) acre;

2.                     Twenty (20%) percent landscaping site coverage;

3.                     Off-street parking in accordance with Section 12.19;

4.                     All sales, repair and display shall be conducted on site;

5.                     All vehicle display and parking stalls to be identified on a site plan;

6.                     All repair/stored (not sale) vehicles may sit idle for no longer than 45 days; and,

7.                     All vehicles shall be licensed and registered with the Wisconsin Department of Transportation.

PART II.                     Subsection 12.45(1)(b) of the Revised Municipal Code of the City of West Allis is hereby deleted and paragraphs (c) through (ddd) are re-lettered as paragraphs (b) through (ccc).

PART III.                     Subsection 12.45(1)(q) (now re-lettered to paragraph (p)) of the Revised Municipal Code of the City of West Allis is hereby amended to read:

 

12.45                     M-1 Manufacturing District.

(q)                     Indoor general wholesale, warehousing and storage.

PART IV.                     Subsection 12.45(1)(ddd) of the Revised Municipal Code of the City of West Allis is hereby created to read:

 

12.45                     M-1 Manufacturing District.

(1)                     Permitted Uses.

(ddd)                     Open/outdoor general wholesale, warehousing and storage, conditioned upon the following:

 

1.                     All outdoor storage shall be screened from the public right of way and any abutting lots by a solid wall or fence (including necessary solid gates) and/or a contiguous landscape buffer;

2.                     In no case shall open storage exceed a greater height than the enclosed screening (except vehicles and associated equipment); and,

3.                     All truck, trailer or commercial vehicles associated with the business shall be stored within the enclosed area, unless otherwise noted on a site plan, approved by the Plan Commission.

PART V.                     Subsection 12.45(2)(ii) of the Revised Municipal Code of the City of West Allis is hereby created to read:

 

12.45                     M-1 Manufacturing District.

(ii)                     Commercial truck, truck trailer, utility trailer, camp trailer, truck camper, motorized camping vans and boat sales, rental and leasing, including repair, rebuilding and parts, and outdoor sales and display conditioned upon the following:

 

1.                     Minimum lot size:  one (1) acre;

2.                     Twenty (20%) percent landscaping site coverage;

3.                     Off-street parking in accordance with Section 12.19;

4.                     All sales, repair and display shall be conducted on site;

5.                     All vehicle display and parking stalls to be identified on a site plan;

6.                     All repair/stored (not sale) vehicles may sit idle for no longer than 45 days; and,

7.                     All vehicles shall be licensed and registered with the Wisconsin Department of Transportation.

PART VI.                     All ordinances or parts of ordinance contravening the provisions of this ordinance are hereby repealed.

 

PART VII.                     This ordinance shall take effect and be in force from and after its passage and publication.
