Resolution authorizing and directing the Director of Public Works/City Engineer to enter into a Maintenance Agreement with the Wisconsin Department of Transportation to address maintenance responsibilities for Context Sensitive Solutions (CSS) features proposed as part of the Zoo Interchange Project along Greenfield Ave (STH 59) at the new berm constructed between the I-894 NB off-ramp and 98th Street including a decorative retaining wall, City emblems, trees, shrubs, perennials, up lighting, and traffic signal cabinet artwork.
 
Body
WHEREAS, the Wisconsin Department of Transportation recognizes that transportation decisions can negatively impact the state's natural and built environments, and the Wisconsin Department of Transportation (WisDOT) continues to identify opportunities that will emphasize and preserve community character and aesthetics.  WisDOT's efforts will focus on designing and building transportation facilities within the context of the natural surroundings and community character, and
 
WHEREAS, the Wisconsin Department of Transportation is proposing Context Sensitive Solutions (CSS) features proposed as part of the Zoo Interchange Project along Greenfield Ave (STH 59) at the new berm constructed between the I-894 NB off-ramp and 98th St. including a decorative retaining wall, City emblems, trees, shrubs, perennials, up lighting installed by the City, and traffic signal cabinet artwork, and
WHEREAS, the Wisconsin Department of Transportation will construct and install the decorative retaining wall, trees, shrubs and perennials at no cost to the City, and
 
WHEREAS, the City of West Allis Department of Public Works will provide the City emblems, up lighting and traffic signal cabinet artwork at City expense, and
 
WHEREAS, the Wisconsin Department of Transportation and City of West Allis Department of Public Works have agreed to share maintenance responsibilities as outlined in the Maintenance Agreement, and
 
NOW, THEREFORE, BE IT RESOLVED By the Common Council of the City of West Allis that the Director of Public Works/City Engineer be and is hereby authorized and directed to enter into this Maintenance Agreement with the Wisconsin Department of Transportation for this work.
 
BE IT FURTHER RESOLVED that the Director of Public Works/City Engineer forward a certified copy of this Resolution, together with the executed Maintenance Agreement, to the office of the Wisconsin Department of Transportation and take whatever further action is required to initiate and affect the services described herein.
 
BE IT FURTHER RESOLVED that the City Attorney be and is hereby authorized to make such  non-substantive changes, modifications, additions and deletions to and from the various provisions of the Agreement, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepare and deliver such other and further documents as may be reasonably necessary to complete the transactions contemplated therein.
