Title

Resolution relative to the Vacation and Discontinuance of a portion of the alley East of South 65^th Street between West Greenfield Avenue and West National Avenue.

Body

WHEREAS, the public interest requires that a Portion of the Alley East of South 65^th Street between West Greenfield Avenue and West National Avenue, shown and legally described on the map of the City of West Allis Engineering Department dated April 16, 2003, File No. Y-1135, which is attached hereto and incorporated herein by reference, be discontinued and vacated; and,

WHEREAS, this Resolution was introduced before the Common Council of the City of West Allis on May 20, 2003; Notice of Pendency of the Resolution to vacate the aforesaid portion of an alley was filed with the Register of Deeds of Milwaukee County on June 3, 2003; Notice of Hearing was published in the official City newspaper on July 9, 2003, July 16, 2003 and July 23, 2003; a copy of said Notice was served or mailed more than thirty (30) days prior to the Hearing in the manner prescribed by law on the owners of all of the frontage of the lots and lands abutting upon the aforesaid portion of an alley proposed to be discontinued; and a Public Hearing was held before the Common Council of the City of West Allis on August 5, 2003; and,

WHEREAS, no sufficient written objection to the vacation and discontinuance was filed with the Acting City Clerk/Treasurer.

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis, in accordance with the authority vested in the Common Council by Sec. 66.1003, Wisconsin Statutes, that a Portion of the Alley East of South 65^th Street Between West Greenfield Avenue and West National Avenue, shown and legally described on the map of the City of West Allis Engineering Department dated April 16, 2003, File No. Y-1135, which is attached hereto and incorporated herein by reference, be and the same is hereby vacated and discontinued, as required by the public interest.

BE IT FURTHER RESOLVED that certain public utility easements for gas, water, storm sewer, sanitary sewer and electric, upon, along, through and under the parcel of property shown and legally described on the map of the City of West Allis Engineering Department dated April 16, 2003, File No. Y-1135, which is attached hereto and incorporated by reference, and rights incidental thereto, and all rights of entrance, maintenance, construction and repair of the same, shall continue following the aforesaid vacation pursuant to the provision of Sec. 80.32(4), Wisconsin Statutes.
