Resolution Granting a Privilege for Encroachment (Major) to New Owner Bestrege LLC for property located at 7335 West Greenfield Avenue (Tax Key No. 453-0118-000).
Body
WHEREAS, by Resolution No. R-2010-0238, adopted November 3, 2010, which was revised and adopted December 21, 2010, the City of West Allis granted to Jolinos Properties, LLC a certain Privilege for Encroachment Beyond the Lot Line and Within Public Street Right-of-Way consisting of a canopy, signs (against building and a projecting sign on the north side of the building) and all light fixtures on that portion of the right-of-way along a part of West Greenfield Avenue on the property located at 7335 West Greenfield Avenue ("Privilege"); and,
 
WHEREAS, the property has now changed ownership to Bestrege LLC, with Jolinos Properties, LLC now having a leasehold interest at 7335 West Greenfield Avenue who desires to retain the Privilege as the tenant; and,
 
WHEREAS, as the leaseholder, Jolinos Properties, LLC has now applied for a Major Privilege for Encroachment Beyond the Lot Line and Within Public Street Right-of-Way consisting of the existing canopy and the installation of a 44 foot by 5 foot 6 inches cedar wood pedlet on that portion of the right-of-way on West Greenfield Avenue; and,
 
WHEREAS, the Privilege for Encroachment (Major) will be granted with the understanding of $2 million for umbrella coverage.
 
NOW, THEREFORE, BE IT RESOLVED that the City of West Allis grants to Bestrege LLC, owner, and Jolinos Properties, LLC, tenant, the Privilege for Encroachment Beyond the Lot Line and within Public Street Right-of-Way consisting of an existing canopy and the installation of a 44 foot by 5 foot 6 inches cedar wood pedlet on that portion of the right-of-way on West Greenfield Avenue on the property located at 7335 West Greenfield Avenue.
 
BE IT FURTHER RESOLVED that additional improvements on said area must require prior approval of the Board of Public Works.
 
BE IT FURTHER RESOLVED that the Director of Public Works with the approval of the City Attorney be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the Privilege for Encroachment (Major) Beyond the Lot Line and within Public Street Right-of-Way, as may be necessary and proper to correct inconsistencies, eliminate ambiguity, comply with City policy and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof.
 
BE IT FURTHER RESOLVED that the Mayor is hereby authorized and directed to execute and deliver the aforesaid Privilege on behalf of the City of West Allis.
