Resolution to approve an Intergovernmental Agreement by and between the City of West Allis and Milwaukee County relative to the purchase of new election equipment in an amount not to exceed $70,000.

WHEREAS, Section 66.0301 of the Wisconsin State Statutes authorizes cooperation between municipalities and allows municipalities to contract with each other for the receipt or furnishing of services or the joint exercise of any power or duty required or authorized by law; and,
WHEREAS, the City of West Allis is in need of new voting equipment since existing aging equipment is over twenty (20) years old and replacement parts continue to become unavailable; and,
WHEREAS, this intergovernmental cooperative initiative will provide for a unified, efficient, and cost-effective vote counting and reporting system, and will benefit the residents of the County and City; and,
WHEREAS, Milwaukee County has agreed to make an initial investment in the purchase of new election equipment infrastructure; and,
WHEREAS, the City of West Allis is required to reimburse thirty percent (30%) of the cost of the election equipment to Milwaukee County by June 30, 2015, pursuant to the Agreement.
NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of West Allis hereby approves the Intergovernmental Agreement by and between the City of West Allis and Milwaukee County, and that the Mayor and City Clerk be and are hereby authorized to enter into the Intergovernmental Cooperation Agreement, a copy of which is attached hereto and made a part hereof, and deliver the aforesaid Agreement on behalf of the City of West Allis.
BE IT FURTHER RESOLVED, that additional capital improvement budgeted equipment, associated items, and accessories are to be purchased from the sole source vendor, Election Systems and Software, as noted in the attached election equipment costs spreadsheet.
BE IT FURTHER RESOLVED, that the City Attorney be and is hereby authorized to make substantive changes, modifications, additions and deletions to and from the various provisions of the Agreement, including any and all attachments, exhibits, addendums and amendments as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepare and deliver such other and further documents as may reasonably be necessary to complete the transaction contemplated therein.
