Resolution declaring that the work of Milwaukee General Construction Company is unsatisfactory and not serving the best interests of the Citizens of the City of West Allis.
Body
WHEREAS, Milwaukee General has contracted with the City of West Allis for roadway projects over a number of years, most recently Projects 4-2001 and 5-2002, both alley reconstruction contracts; and,
WHEREAS, the Common Council has awarded Milwaukee General contracts on the expectation that all work would be performed satisfactorily; and,
WHEREAS, Milwaukee General has unsatisfactorily performed work on both recent alley reconstruction contracts; unsatisfactory work including, but not limited to the following:
* Poor quality workmanship to the extent that some concrete slabs were ordered to be removed and replaced.
* Failure to meet deadlines for project completion.
* Disregard for the impact of the alley closures on the abutting property owners and on the operation of abutting business.
* Through carelessness, has caused unnecessary damage to adjacent private property during the course of the work.
* Failure to rectify damage to adjacent private property in a timely and efficient manner leading to excessive insurance claims by residents.
* Final cleanup work not completed. For example, on Project 4-2001, substantial completion was in June/July of 2001, but final acceptance of work was approved in November of 2002. Final acceptance of work on Project 5-2002 has not been made due to final cleanup work not completed.
NOW, THEREFORE, BE IT RESOLVED by the Common Council and Board of Public Works of the City of West Allis, Wisconsin, that the City goes on record that the work of Milwaukee General Construction Company is unsatisfactory and has not compiled with the terms or spirit of the contracts, thereby not serving the interests of the Citizens of the City of West Allis.
BE IT FURTHER RESOLVED, that the City Engineer shall take into consideration the past work performance of Milwaukee General when making contract award recommendations to the Board of Public Works and Common Council.
BE IT FURTHER RESOLVED, that the City Engineer is directed to send a copy of this Resolution to Milwaukee General and shall keep the Board of Public Works informed on Milwaukee General's performance on any future contracts, if awarded.
