Title
Resolution authorizing the Community Development Authority of the City of West Allis to enter into all necessary contracts and expend City Contingency Reserve funds, not to exceed $15,000, and Slum & Blight Removal CDBG funds, not to exceed $99,000 on behalf of the City of West Allis, for the demolition-related expenses of various nuisance and abandoned dwellings.
 
Body
WHEREAS, the Building Inspections and Neighborhood Services Director has obtained the proper court-ordered raze/repair orders for various properties around the City (the "Properties"), to eliminate blighting and unsafe environments that the Properties present; and,
 
WHEREAS, certain Properties' blighting conditions qualify all demolition-related expenses to be funded by the remaining balance of approximately $99,000 of the Community Development Block Grant (CDBG) Slum & Blight Removal activity as the demolition-related expenses meet the CDBG Program's national objective of aiding in the prevention or elimination of slums or blight; and,
 
WHEREAS, certain Properties' blighting conditions do not qualify to be funded by the CDBG Slum & Blight Removal and demolition-related expenses need to be funded with City contingency funds, not to exceed $15,000; and,
 
WHEREAS, the Community Development Authority of the City of West Allis (the "Authority") reports that it duly advertised for bids for demolition of Properties and such bid responses are due December 4, 2014; and,
 
WHEREAS, the Common Council of the City of West Allis (the "Council") hereby authorizes and directs the Executive Director of the Authority to manage the demolition of all certain Properties that are funded with City contingency funds and CDBG funds and are identified by the Building Inspections and Neighborhood Services Department as Nuisance and Abandoned Dwellings, and execute and deliver the demolition-related contract and any/all amendments to the lowest bidder; and,
 
WHEREAS, the funding of demolition-related expenses shall come from the remaining balance of approximately $99,000 of the Community Development Block Grant (CDBG) Blight & Blight Removal activity, and up to $15,000 of City Contingency Reserve funds; and,
 
WHEREAS, the amount in Contingency Reserve as of January 1, 2014, is $3.2 million; and,
 
WHEREAS, it is necessary to provide Contingency Reserve funding for plans and specifications expenses to the Building Inspections Maintenance Account 100-2406-524.32-04.
 
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis as follows:
 
1.      That the Community Development Authority of the City of West Allis is hereby authorized to expend the aforementioned funds, manage the demolition of, enter into, execute, and sign all necessary documents for a demolition contract and any/all amendments for the demolition of various Properties identified by the Building Inspections and Neighborhood Services Department as Nuisance and Abandoned Dwellings.
 
2.      That the remaining balance of approximately $99,000 of the Community Development Block Grant (CDBG) Blight & Blight Removal activity be and is hereby appropriated, and an amount not to exceed $15,000 be and is hereby appropriated from the City Contingency Reserve fund.
 
3.      That the City Attorney be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the demolition contract, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepare and deliver such other and further documents as may be reasonably necessary to complete the transactions contemplated therein.
