Title

Resolution relative to the State of Wisconsin Department of Administration's Distribution of School Levy Property Tax Credit and the Lottery and Gaming Property Tax Credit.

 

Body

WHEREAS, 2007 Wisconsin Act 190 became law upon its enactment on March 27, 2008 and its date of publication on April 10, 2008; and,

 

WHEREAS, 2007 Wisconsin Act 190 provides that the State School Levy Property Tax Credit and the Lottery and Gaming Property Tax Credit will be first distributed to counties, which would then distribute the tax credit monies to other taxing jurisdictions; and,

 

WHEREAS, under prior law, these State distributed tax credits went directly to municipalities; and,

 

WHEREAS, this change will result in the loss of interest earnings to the City; and,

 

WHEREAS, 2007 Wisconsin Act 190 provided two exemptions to the credits going directly to the county (the first being where a municipality receives $3 million or more in such payments, and the second being where a municipality allows taxpayers to pay their taxes in three or more installments); and,

 

WHEREAS, the City of West Allis does receive more than $3 million in such payments and does provide for tax payments in three installments; and,

 

WHEREAS, it is necessary to notify the Secretary of the Department of Administration that the local governing body has approved directing its staff to make a request that the credits be distributed directly to the City and not to the County.

 

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the City Administrative Officer, Clerk/Treasurer is hereby authorized and directed to request on behalf of the City of West Allis that the School Levy Property Tax Credit and the Lottery Gaming Property Tax Credit be distributed directly to the City of West Allis rather than to Milwaukee County.

 

BE IT FURTHER RESOLVED that the City Administrative Officer, Clerk/Treasurer is hereby authorized and directed to send the required notification of this action to the Department of Administration Secretary Michael Morgan at his Madison business address.
