Ordinance to amend various subsections of Sections 12.06, 12.10, and 12.30 thru 12.37 regarding residential bulk requirements and accessory residential building size requirements.

Part I. Section 12.06 of the Revised Municipal Code is hereby amended to read as follows by adding or changing the following definitions:
12.06 DEFINITIONS. Whenever a term defined in this Section appears in the text of this Subchapter, its meaning shall be construed to be the definition set forth in this Section.

Accessory Building - Residential. An attached or detached private garage (see definition of "Garage, Private"), a storage shed, a gazebo, or other residential structure that is subordinate and incidental to the one- or two-family dwelling main building and is located on the same lot as such main building.
Building Coverage. The horizontal area measured within the outside of the exterior walls of the ground floor of all principle and accessory buildings on a lot. The area shall include cantilevered habitable building areas and exclude unroofed areas of decks, platforms, patios, terraces and similar areas.
Garage, Private. An accessory attached or detached building designed and used primarily for the storage and parking of vehicles owned and operated by the occupants of the lot on which the building is located. Vehicle repair is prohibited in a private garage.

Part II. Section 12.10(2)(d) of the Revised Municipal Code is amended to read as follows:
12.10 General Provisions.

(2) Accessory Buildings.
(a) Overhanging roof eaves projecting into required setbacks as listed hereafter will not be considered an obstruction.

Part III. Section 12.30(2) of the Revised Municipal Code is amended to read as follows:
12.30 RE RESIDENTIAL ESTATE DISTRICT.

(2) Site Area and Accessory Building Area.
(a) The total combined building coverage of the allowed main building, private garage(s), and accessory building(s) shall occupy no more than forty percent (40%) of the lot area of an interior lot or forty-five (45%) of the lot area of a corner lot.
(b) One (1) private attached garage per dwelling unit or one (1) private detached garage per lot is permitted. The garage(s) shall not exceed one thousand (1,000) square feet in total area, and a detached garage shall not exceed fifteen (15) feet in height.
(c) One (1) storage shed is permitted per lot. A storage shed may be used for residential material storage but may not be used for vehicle parking or storage. A storage shed may not exceed one hundred and fifty (150) square feet in area or twelve (12) feet in height and may not have a door greater than five (5) feet in width.
(d) One (1) residential accessory building other than a private garage or storage shed is permitted per lot. This building may not be used for vehicle parking or storage, may not exceed one hundred and fifty (150) square feet in area and may not exceed twelve (12) feet in height.
(e) There shall be a minimum of one (1) foot between detached accessory structures and they shall not be physically connected. See Section 12.10(2) for other bulk requirements for detached residential accessory buildings.

Part IV. Section 12.31(4) of the Revised Municipal Code is amended to read as follows:
12.31 RA-1 RESIDENCE DISTRICT.

(7) Front Yard. Every lot shall have a front yard of not less than twenty (20) feet in depth. Overhanging roof eaves projecting not more than two (2) feet will not be considered an obstruction.
(8) Side Yards. There shall be on every lot occupied by a one- or two-family dwelling, two (2) side yards, the east and south of which shall be at least eight (8) feet wide and the north and west of which shall be at least four (4) feet wide, except where a side yard adjoins a street, it shall be at least (20) feet wide. Overhanging roof eaves projecting not more than two (2) feet will not be considered as obstructions.

Part IX. Section 12.36(1)(b), (4) and (5) of the Revised Municipal Code is amended to read as follows:
12.36 RB-2 RESIDENCE DISTRICT.

(1) Permitted Uses.

(b) Multiple family dwellings, containing not more than four (4) dwelling units, provided the lot has one thousand eight hundred (1,800) square feet of land per dwelling unit for an interior lot, or one thousand five hundred (1,500) square feet of land area per dwelling unit for a corner lot. Other bulk requirements shall be in accordance with the requirements of the RC-1 Residence District.

(5) Lot Area. The minimum lot area for a two-family dwelling shall not be less than three thousand six hundred (3,600) square feet. Single-family dwellings may be constructed on lots of less than three thousand six hundred (3,600) square feet.

Part X. Section 12.37(1)(b) and (3)(g) of the Revised Municipal Code is amended to read as follows:
12.37 RC-1 RESIDENCE DISTRICT.

(b) Multi-family dwellings. (See Section 12.10(2) for other bulk requirements for accessory buildings.)

(3) Special Uses.
(g) The following uses are special uses requiring Common Council approval. The bulk requirements for Special Use will be established by the Common Council.

Part XI. All ordinances or parts of ordinances contravening the provision of this ordinance are hereby repealed.
Part XII. This ordinance shall take effect and be in force from and after its passage and publication.
