Title

Resolution to enter into a contract between the City of West Allis and the City of Milwaukee for disbursement of Neighborhood Stabilization Program funds from the Wisconsin Department of Commerce.

 

Body

WHEREAS, the Wisconsin Department of Commerce (“Commerce”) received $38.9 million in

Neighborhood Stabilization Program (“NSP”) funds from the U.S. Department of Housing and Urban Development (“HUD”); and,

 

WHEREAS, through Resolution No. R-2009-0249, the Common Council authorized the City of West Allis to enter into an Intergovernmental Agreement with Milwaukee County, City of Milwaukee and City of Cudahy in the creation of a Milwaukee County Regional Consortium, who was awarded $1.4 million in NSP funds from Commerce in May 2009; and,

 

WHEREAS, Commerce has awarded the consortium an additional $1,997,556, with $848,192 being awarded specifically to the City of West Allis; and,

 

WHEREAS, the City of Milwaukee, acting through its Community Development Grants Administration (“Milwaukee”) is the managing member of the Milwaukee County Regional Consortium and administers all NSP funds to consortium members, including the City of West Allis; and,

 

WHEREAS, the City of Milwaukee and City of Milwaukee shall enter into two (2) contracts for the disbursement of NSP funds from the Wisconsin Department of Commerce to the City of West Allis, and the administration, oversight and reimbursement of NSP funds awarded to the City of West Allis; and,

 

WHEREAS, one (1) contract pertains to demolition eligible expenses and one (1) contract pertains to acquisition/rehabilitation/new construction eligible expenses.

 

NOW THEREFORE BE IT RESOLVED, that the Common Council of the City of West Allis hereby approves the contract between the City of West Allis and the City of Milwaukee for disbursement of Neighborhood Stabilization Program funds from the Wisconsin Department of Commerce to the City of West Allis, and the administration, oversight and reimbursement of NSP funds awarded to the City of West Allis.

 

BE IT FURTHER RESOLVED, that the Director of Development or his designee, in consultation with Mayor Devine and the City Attorney, is hereby authorized to execute the attached Contract and participate and represent the City of West Allis in the formation of a Consortium.

 

BE IT FURTHER RESOLVED, that the City Attorney be and hereby authorized to make substantive changes, modifications, additions and deletions to and from the various provisions of the Contract, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepare and deliver such other and further documents as may be reasonably necessary to complete the transactions contemplated therein.
