Title

An Ordinance to repeal and recreate Section 13.075, 13.13, and subsection 13.255(2)(l) of the City of West Allis Revised Municipal Code relative to residential heating, ventilating, and air conditioning permits, contractor requirements and permit fees.

 

Body

The Common Council of the City of West Allis do ordain as follows:

 

Part 1.                     Section 13.075 of the Revised Municipal Code of the City of West Allis is hereby repealed and recreated to read as follows: 

 

13.075                     One or Two Family HVAC Permit & Inspection.

 

                     (1)                     Permit Required.  A permit is required for the installation of a new or replacement of an existing heating, air conditioning or other appliance or fixture used to heat or ventilate a one or two family dwelling.  Ductwork associated with heating, air conditioning or ventilating may also require a permit and may be included with the appliance's original installation or replacement or separately as an alteration permit.  The building inspector will determine if a permit is required for "ductwork only" alterations.

 

                     (2)                     Certified HVAC Contractor and HVAC Qualifier Certification.  Unless otherwise allowed by the State of Wisconsin Dwelling Code, only a contractor who is registered by the State of Wisconsin as an HVAC Contractor may secure a permit as required in (1) above.  Unless otherwise allowed by the State of Wisconsin only an HVAC Contractor who employs a person holding a State of Wisconsin HVAC Qualifier Certification may secure an HVAC Affidavit Permit cited in (5).

 

                     (3)                     Contractor Registration.  Contractors applying for an HVAC permit shall file certification credentials of the Contractor and/or Qualifier with the Department.  The person employed as a qualifier for the business shall sign each HVAC Affidavit Permit and include the State of Wisconsin assigned HVAC Contractor and HVAC Qualifier Number.

 

                     (4)                     Inspection.  An inspection shall be required of the installation, replacement, or alteration of heating and ventilation equipment except as cited in (5).

 

                     (5)                     HVAC Affidavit Permit.  An HVAC Contractor employing an HVAC Qualifier may apply for an HVAC Affidavit Permit for the installation of a replacement furnace or air conditioning appliance.  An affidavit permit for a one or two family dwelling will exempt the inspection requirement stated in (4) upon the signature of the HVAC Contractor/Qualified person who states the work will be performed in a safe, legal and workmanlike manner and the completed installation will conform to all applicable regulations.  The inspector may periodically inspect certain affidavit permits to insure compliance.  The inspector may revoke the ability of a contractor to secure Affidavit Permits upon written notice. 

 

Part II.                     Section 13.13 of the Revised Municipal Code of the City of West Allis is hereby repealed and recreated to read as follows:

Part III                     Section 13.255(2)(l) of the Revised Municipal Code of the City of West Allis is hereby repealed and recreated to read as follows:

Part IV.  All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed.

 

Part V.  Except as stated in Part IV this ordinance shall take effect and be in force from and after its passage and publication.
