Resolution to approve a Purchase and Sale Agreement by and between the Community Development Authority of the City of West Allis and Burnham Pointe, LLC for the property located at 5817 W. Burnham St.

 

Body

 

WHEREAS, the Community Development Authority of the City of West Allis (the "Authority") is the owner of certain vacant property located at the 5817 W. Burnham St. (the "Property"); and,

 

WHEREAS, the West Allis Plan Commission, at its meeting of July 28, 2004, recommended approval of the sale of the Property; and,

 

WHEREAS, a Class II Notice of a Public Hearing on the proposed sale has been duly published and a Public Hearing was held before the Authority on September 2, 2004.

 

WHEREAS, the Authority, by Resolution No. ______, adopted September 2, 2004, approved the sale of certain real property to Burnham Pointe, LLC.

 

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis, pursuant to Wis. Stats. 66.431(9)(a)1., that the Community Development Authority of the City of West Allis is authorized to proceed with the disposition of certain real property as described in the Purchase and Sale Agreement and Development Agreement, hereby attached and made a part hereof.

 

BE IT FURTHER RESOLVED that the Director of Development be and is hereby authorized to execute and deliver the Agreements on behalf of the City of West Allis.

 

BE IT FURTHER RESOLVED that the City Attorney be and is hereby authorized to make such non-substantive changes, modifications, additions and deletions to and from the various provisions of the Agreement, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepare and deliver such other and further documents as may be reasonably necessary to complete the transactions contemplated therein.
