Title

An Ordinance to create Sections 14.34 and 14.58, to repeal Subsections 14.55(11) and 14.57(11), and to repeal and recreate Section 14.85 of the City of West Allis Revised Municipal Code regarding electric services, contractor licensing requirements and permit fees.

 

Body

The Common Council of the City of West Allis do ordain as follows:

 

PART I.                     Section 14.34 of the Revised Municipal Code is hereby created as follows::

 

14.34                     RESIDENCE WITHOUT ELECTRIC SERVICE UNSAFE & UNINHABITABLE

                     Every residential dwelling unit shall be supplied with proper electric service from the utility company or other proper electric service such as wind energy supply, when approved by the electrical inspector.  Any residence without electric service is deemed uninhabitable and unsafe and shall not be occupied for living purposes until proper electric service is provided.

 

14.35 - 14.49 RESERVED

 

PART II.                     Section 14.55(11) of the Revised Municipal Code is hereby repealed.

 

PART III.                     Section 14.57(11) of the Revised Municipal Code is hereby repealed.

 

PART IV.                     Section 14.58 of the Revised Municipal Code is hereby created to read as follows:

 

14.58                     SPECIAL LICENSE.  The Director of the Department of Building Inspections may issue an Electrical Contractor License to a contractor to secure a one-time per year electrical permit subject to notification to the Electrical Review Board.

 

PART V.  Section 14.85 of the Revised Municipal Code is hereby repealed and recreated to read as follows:

(31)                     Permit Refund.  Excepting plan review, initiation, or special fees, that portion of an electrical permit in excess of $100 is eligible to be refunded to the permit holder for work not yet started.  A refund request is to be made in writing to cancel the permit and received in the Building Inspection office within 120 days of the issuance of the permit.  Requests received after 120 days may be referred to the Common Council.

 

(32)                     The Director may waive or reduce the fee of any permit upon proper cause.

 

PART VI.                     All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed.

 

PART VII.                     This ordinance shall take effect after publication and become effective on January 1, 2010.
