Title

Resolution approving an additional $20,000 U.S. EPA Revolving Loan Fund Subgrant from the City of West Allis to the Community Development Authority of the City of West Allis for the property located at 1445-1501 S. 113 St.

 

Body

WHEREAS, the City of West Allis (“City”) received a $1,000,000 Brownfields Cleanup Revolving Loan Fund (“RLF”) Grant for Hazardous Substance and Petroleum Contaminated Sites in 2011; and,

 

WHEREAS, the City has identified the 1445-1501 S. 113 St. (the “Property”) site as a candidate for an RLF Subgrant due to known environmental contamination and required cleanup; and,

 

WHEREAS, the Community Development Authority of the City of West Allis (the “Authority”) has acquired the Property from the current owner, RJB Properties, LLC, and will be eligible for the RLF Grant once ownership has transferred to the Authority; and,

 

WHEREAS, the City granted a $100,000 RLF Subgrant to the Authority to fund environmental remediation on the Property on Resolution R-2015-0107 dated April 21, 2015; and,

 

WHEREAS, the Authority is required to fund all EPA RLF Subgrant-related expenses upfront, and will then be reimbursed by the City of West Allis; and,

 

WHEREAS, the Authority if required to provide a 20% match to the project.

 

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that it hereby approves an additional $20,000 U.S. EPA Revolving Loan Fund Subgrant from the City of West Allis to the Community Development Authority of the City of West Allis for the property located at 1445-1501 S. 113 St.

 

BE IT FURTHER RESOLVED that the Director of Development, or his designee, is hereby authorized and directed to enter into a Revolving Loan Fund Subgrant Contract by and between the Community Development Authority of the City of West Allis and the City of West Allis and take any and all other actions on behalf of the City of West Allis which they deem necessary or desirable in connection with the U.S. EPA Revolving Loan Fund Subgrant including, without limitation, negotiating, executing, delivering, and performing obligations in connection with the Subgrant.

 

BE IT FURTHER RESOLVED that the City Attorney be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of any and all U.S. EPA Revolving Loan Fund Subgrant-related documents between the Community Development Authority of the City of West Allis and the City of West Allis, and/or any other documents as may be necessary and proper to correct inconsistencies, eliminate ambiguity, and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepare and deliver such other and further documents as may be reasonably necessary to complete the transactions contemplated therein.
