Title

Resolution to extend the Moratorium on Pawn Shops, Secondhand Stores, Secondhand Jewelry Dealers as defined in Section 9.15 of the Revised Municipal Code for an additional 90 days.

 

Body

WHEREAS, the City of West Allis currently issues licenses and requires special use consideration for Pawn Shops, Secondhand Stores, Secondhand Jewelry Dealers in many locations throughout the City in accordance with Section 9.15 of the Revised Municipal Code; and,

 

WHEREAS, Resolution number R-2010-0143 was adopted by the Common Council of the City of West Allis on June 15, 2010 imposing a moratorium on Pawn Shops, Secondhand Stores, Secondhand Jewelry Dealers as defined in Section 9.15 of the Revised Municipal Code; and,

 

WHEREAS, the Department of Development is preparing a proposed ordinance to amend the terms, conditions and restrictions under which such uses are to be granted; and,

 

WHEREAS, the City has no intention of permanently denying Pawn Shops, Secondhand Article Dealers, Junk Shops, and Secondhand Jewelry Dealers license to any qualified person, but seeks only a brief and temporary interval in license and occupancy permit issuance to consider if trends in the marketplace threaten to undermine the health, safety and welfare of the City of West Allis residents; and

 

WHEREAS, because the timely assistance, analysis and input from various City departments is needed to effectively review and evaluate licensing policy, the Common Council directs formation of a group consisting of representatives from the Police Department, the Department of Development and the Department of Building Inspections and Neighborhood Services, and that all City departments are directed to cooperate and participate in this review and evaluation process:

 

WHEREAS, it is in the City's interest to put all current and future applications for new Pawn Dealers, Secondhand Article Dealers, Junk Shops, and Secondhand Jewelry Dealers on hold until the proposed ordinance is introduced and acted upon.

 

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the existing moratorium be extended and imposed on the granting and issuing of all aforementioned license and permits for an additional period of 90 days.

 

BE IT FURTHER RESOLVED that the moratorium will terminate upon expiration of said 90-day period or the pending ordinance is enacted, whichever is sooner.

 

BE IT FURTHER RESOLVED that said moratorium shall not apply to renewal applications for the same address as long as the location of the establishment remains the same as set forth in Resolution number R-2010-0143.
