Resolution authorizing the Director of Public Works to enter into an Intergovernmental Cooperation Agreement for Use and Distribution of Proceeds for Wisconsin Department of Natural Resources "2007" Recycling Efficiency Incentive Grants.

 

Body

WHEREAS, the City of West Allis hereby requests financial assistance under s.287.23 Wis. Stats., Chapters NR 542, 544 and 549, Wis. Admin. Code, for the purpose of planning, constructing or operating a recycling program with one or more components specified in s.287.11(2)(a) to (h), Wis. Stats., and additional funding from aforementioned authorizing statutes in the form of REI grants; and,

 

WHEREAS, it has been proposed that the City of West Allis enter into an Intergovernmental Cooperation Agreement with the City of Greenfield, the City of St. Francis, the City of Cudahy and the Village of Shorewood to collaborate in efforts to improve recycling and waste reduction; and,

 

WHEREAS, such intergovernmental cooperation will allow said municipalities to be eligible for a Recycling Efficiency Incentive Grant from the Wisconsin Department of Natural Resources; and,

 

WHEREAS, the receipt of the grant and participation in the program will benefit the citizens of the City of West Allis, the City of Greenfield, the City of St. Francis, the City of Cudahy and the Village of Shorewood.

 

NOW, THEREFORE, BE IT RESOLVED that the Director of Public Works be and is hereby authorized to enter into the Intergovernmental Cooperation Agreement, a copy of which is attached hereto and made a part hereof, and deliver the aforesaid Agreement on behalf of the City of West Allis.

 

BE IT FURTHER RESOLVED that the necessary funds have been provided to pay the liability that may be incurred by the City of West Allis under the aforesaid Agreement.

 

BE IT FURTHER RESOLVED that the City of West Allis hereby authorizes the Director of Public Works, an official or employee of the responsible unit, to act on its behalf to:  submit an application to the Department of Natural Resources for financial assistance under s.287.23, Wis. Stats., Chapters NR 542, 544 and 549, Wis. Admin. Code; sign necessary documents; and submit a final report.

 

BE IT FURTHER RESOLVED that the City Attorney be and is hereby authorized to make such changes, modifications, additions and deletions to and from the various provisions of the aforesaid Agreement, including any and all attachments, exhibits, addendums and amendments as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepare and deliver such other and further documents as may reasonably be necessary to complete the transaction contemplated therein.
