Resolution adopting a Conveyance of Rights in Land and Temporary Construction Easement by and between the City of West Allis and the State of Wisconsin, Department of Transportation, regarding certain lands located on the We Energies property located east of I-894 at W. Dakota Street (Tax Key No. 518-9944-001).

WHEREAS, on April 6, 1954, the Wisconsin Electric Power Company (precursor to We Energies) granted a license to the Town of Greenfield (precursor to the City of West Allis) to maintain and operate a drainage ditch or waterway and a culvert over and across said granter's premises in the City of West Allis, County of Milwaukee, State of Wisconsin, described as that part of a parcel of land located in the Southeast one-quarter (1/4) and Southwest one-quarter (1/4) of Section Number Eight (8) in Township Six (6) North, Range Twenty-One (21) East in the City of West Allis, Milwaukee County, Wisconsin which was recorded in the office of the Register of Deeds for Milwaukee County in Deed No. 3328, Page No. 612, as Document No. 3321596; and
WHEREAS, this parcel is within the right-of-way acquired or to be acquired for the reconstruction of the Dakota Street Pedestrian Bridge, as shown on the right-of-way plat for Project ID 1090-07-23 showing a date of 10/12/2012, and all subsequent revisions, containing so much of those certain licenses as recorded in the office of the Register of Deeds for Milwaukee County, State of Wisconsin; and
WHEREAS, the parties agree that the State of Wisconsin, Department of Transportation needs this parcel for the purposes of constructing, operating and maintaining a public highway and appurtenant facilities on, over, under or across the said land; provided, however that Grantor reserves to itself the subordinate right to cross, traverse, or otherwise occupy said land with its present and future overhead or underground transmission lines, appurtenant facilities, and supporting structures in a manner consistent with the purposes of this conveyance and in a manner which will not interfere with normal highway maintenance and operation; and
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the Director of Public Works/City Engineer be and is hereby authorized and directed to execute the Conveyance of Rights in Land and Temporary Construction Easement with the WisDOT for the Project (State ID 1090-07-73 and 1100-03-79), a copy of the Conveyance of Rights in Land and Temporary Construction Easement are attached hereto and by reference made a part hereof.
BE IT FURTHER RESOLVED that the State of Wisconsin be and is hereby authorized and directed to record a certified copy of this resolution with the Register of Deeds Office, Milwaukee County, Wisconsin.
