Title

Resolution authorizing the Director of Development to execute an amendment to the Community Development Block Grant- Emergency Assistance Program (CDBG-EAP) Agreement between the City of West Allis and the State of Wisconsin Department of Commerce for accepting an additional $2,251,000 of assistance.

 

Body

WHEREAS, the City of West Allis sustained substantial damage from rains and flood waters in June 2008; and,

 

WHEREAS, on March 9, 2009 the City of West Allis applied to the Wisconsin Department of Commerce for CDBG-EAP funds to assist with June 2008 flood damage; and,

 

WHEREAS, on June 9, 2009, the Wisconsin Department of Commerce (“Commerce”) announced that the City of West Allis was awarded $4,162,000 in CDBG-EAP funds; and,

 

WHEREAS, on November 3, 2009, through Resolution No. R-2009-0244, the Common Council directed and authorized the Community Development Authority (“CDA”) of the City of West Allis to execute a Grant Amendment for an additional $400,000 in CDBG-EAP funds awarded to the City from the Wisconsin Department of Commerce; and,

 

WHEREAS, on December 1, 2009, the City submitted a request to Commerce for an additional $2,251,000 in CDBG-EAP funds; and,

 

WHEREAS, on May 18, 2010, Commerce awarded the City the requested $2,251,000 in CDBG-EAP funding, which includes the following projects:

 

1.                     $257,000 for the demolition and relocation of seven residential properties;

2.                     $653,000 for the demolition of the former Milwaukee Gray Iron foundry and the former Mykonos restaurant;                     

3.                     $675,000 for a storm sewer relief project, from 2040 S. 67 Pl. to the intersection of S. 68 St. and W. Rogers St.

4.                     $626,000 for a sanitary sewer flood proofing project in the neighborhood bounded by W. Beloit Road and W. Jackson Dr. from S. 74 Street to S. 76 Street; and

5.                     $40,000 to complete the restoration of the catch basin at S. 67 Pl. and W. Becher St.

 

WHEREAS, the Common Council desires implementation of the amendment by the Community Development Authority of the City of West Allis.

 

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis as follows:

 

1.                     That the Community Development Authority of the City of West Allis is hereby directed and authorized to implement the project activities as herein described in the amendment in accordance with Contract # EAP 08-20 requirements;

 

2.                     That the Director of the West Allis Development Department is hereby authorized to execute, on behalf of the City, a Grant Amendment, from the State of Wisconsin Department of Commerce in the amount of $2,251,000;

 

3.                     That the City Attorney be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the Agreement, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepare and deliver such other and further documents as may be reasonably necessary to complete the transaction contemplated therein.
