Resolution authorizing and directing the Director of Public Works/City Engineer to enter into a contract amendment to the three party professional services contract between the City of West Allis, the Wisconsin Department of Transportation and Bloom Companies, LLC for the preparation of final plans on the Crosstown Connector Bike and Pedestrian Trail and for preparation of an Alternatives Analysis to provide a bike trail crossing of the Union Pacific Railroad, in an amount not to exceed $2,160.82 to the City.
Body
WHEREAS, the Common Council of the City of West Allis by Resolution Number R-2005-0099 adopted on March 15, 2005, approved a State/Municipal Agreement for a Transportation Enhancement Project for the Engineering, Right-of-Way Acquisition and Construction Cost for the Crosstown Connector Bike and Pedestrian Trail; and,
 
WHEREAS, the Common Council of the City of West Allis by Resolution Number R-2010-0193 adopted on September 7, 2010 approved an additional State/Municipal Agreement for a Transportation Enhancement Project for the Engineering, Right-of-Way Acquisition and Construction Cost for the Crosstown Connector Bike and Pedestrian Trail; and,
 
WHEREAS, the Wisconsin Office of the Commissioner of Railroads denied our petition on October 3, 2012 for two new at grade bike trail crossings of the Union Pacific Railroad tracks; and,
 
WHEREAS, it is, therefore, necessary to amend the professional services contract with
Bloom Companies (LLC) for the final plan preparation of only the western 1 mile of off road trail from the Oak Leaf Trail connection in Greenfield Park, east of 124th Street, to S. 108th Street; and,
 
WHEREAS, it is also necessary to amend the professional services contract with Bloom Companies (LLC) for an Alternative Analysis memorandum analyzing the design challenges, real estate needs, safety issues, design and construction timeframes and rough construction cost estimates for six new alternatives to cross the Union Pacific Railroad tracks east of S. 108th Street;
 
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis as follows:
 
1. That the Scope of Services for the project area, a copy of which is hereby attached and made a part hereof, is hereby approved.
 
2. That the Director of Public Works/City Engineer be and is hereby authorized to make such non-substantive changes, modifications, additions and deletions to and from the various provisions of the Contract, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepare and deliver such other and further documents as may be reasonably necessary to complete the transactions contemplated therein.
 
BE IT FURTHER RESOLVED that the Director of Public Works/City Engineer is authorized, on behalf of the City, to execute the aforesaid contract documents.
 
BE IT FURTHER RESOLVED that the sum of $10,804.08 of which up to $8,643.26 was approved for funding by the Wisconsin Department of Transportation (80% federal/state share with the remaining 20% local share, or $2,160.82, to be funded by Tax Incremental Financing and/or Community Development Block Grant (CDBG) funds.
