Title

Resolution to approve a cost sharing project agreement with the City of Brookfield for the reconstruction of the storm sewer under S. 124th Street of which the City of West Allis’ share is $12,500

 

Body

WHEREAS, Wisconsin Statues Section 66.0301 authorizes any municipality to enter into an Intergovernmental Cooperation Agreement with another municipality for, among other things, the joint exercise of any power authorized by law; and,

 

Whereas, This storm sewer collapsing and in need of reconstruction; and

 

Whereas, The City of Brookfield and City of West Allis share jurisdictional ownership of the storm sewer and will share the construction costs; and

 

Whereas, The City of West Allis will be the lead agency in the project construction; and

 

WHEREAS, the City of West Allis and the City of Brookfield desire to enter into an Agreement to set forth their understanding with respect to the construction of the aforesaid public improvements.

 

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the Agreement by and between the City of West Allis and the City of Brookfield, a copy of which is attached hereto and by reference made a part hereof, for the reconstruction of the storm sewer in S. 124th Street be and is hereby approved.

                     

BE IT FURTHER RESOLVED that the City Engineer is hereby authorized and directed to execute and deliver the aforesaid Agreement on behalf of the City of West Allis. 

 

BE IT FURTHER RESOLVED that the City Engineer, with the approval of the City Attorney, be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the agreement as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof and to protect the interests of the City, including but not limited to, any and all changes necessary to preserve the intent of the Common Council of the City of West Allis.
