Title

Resolution relative to the notice of hearing in consideration of a request for the vacation and discontinuance of a portion of public alleyway between S. 74 and S. 75 St. north of W. National Ave. submitted by Paul and Lisa Quesnell, property owners (1616 S. 75 St.)

 

Body

WHEREAS, the City has received a request for an alley vacation between S. 74 and S. 75 Streets (just north of W. National Ave.). The applicant, Paul and Lisa Quesnell, own residential property located at 1616 S. 75 St. and have requested to vacate a portion of an existing improved alley abutting their property for purposes of expanding their land area and an accessory structure on their property.  The subject area being requested vacated is shown and  identified as a map Exhibit A of the City of West Allis dated September 23, 2020, which is attached and incorporated within this notice; and,

 

WHEREAS, the Common Council of the City of West Allis directs staff to publish a notice of hearing on November 17, 2020, at 7p.m., or as soon thereafter as the matter may be heard, in the Common Council Chambers of the City Hall, 7525 W. Greenfield Ave., West Allis, WI, upon a resolution herein described and will act upon said resolution at said time and place; and,

 

WHEREAS, State Statutes requires publishing a class 3 notice and personal service on abutting landowners at least 30 days before a public hearing or, if they can’t be personally served, the notice needs to be mailed to them at least 30 days ahead of time. 

 

NOW, THEREFORE, BE IT RESOLVED, that the notice of hearing, for the vacation and discontinuance of a portion of City alley right-of-way/alley way between S. 74 and S. 75 St. north of W. National Ave., be published in the official City newspaper on October 23, 2020, October 30, 2020 and November 6, 2020, and that the Hearing be scheduled before the Common Council on November 17, 2020 at 7:00 p.m. or as soon thereafter as the matter may be heard; that a copy of the aforesaid Notice be served or mailed more than thirty (30) days prior to the Hearing in the manner prescribed by the law on the owners of all of the frontage of the lots and lands abutting upon the said portion of right-of-way proposed to be vacated and discontinued.

 

Recommendation

Plan Commission recommends denial.
